Howard N. Gorney

Howard N. Gorney, MWI Mediator/Arbitrator, combines over thirty years as a commercial attorney with mediation and arbitration skills to assist parties in reaching resolution in financial disputes.  Mr. Gorney has mediated and arbitrated over 100 commercial matters.  In addition to serving on the mediation/arbitration panel for MWI, where he has mediated a number of cases involving contract and franchise issues, Mr. Gorney is a member of several mediation and arbitration panels. He serves on the Mediation Panels of the United States Bankruptcy Courts of the Southern District of New York and the District of Delaware, where he has mediated complex commercial and bankruptcy matters involving multiple parties and millions of dollars.

Mr Gorney also is a member of the Arbitration Panels for the National Association of Securities Dealers, the National Arbitration Forum, and the Department of the Commonwealth of Massachusetts which arbitrates home contractor construction disputes.  Mr. Gorney has completed 40 hours of mediation training with Mediation Works, Inc., in accordance with Mass. General Laws, Ch. 233 §23E.  In his legal practice, Mr. Gorney represented clients in significant, multi-million dollar commercial and insolvency matters in courts throughout the country, including Massachusetts, New York, Delaware and Texas.  He has been involved in hundreds of bankruptcy cases, including representing secured lenders, creditors committees, lessees and lessors, acquirors of bankruptcy assets, as well as franchisors and franchisees.

A member of Nixon Peabody LLP (formerly Peabody & Brown) for over eighteen years, Mr. Gorney served as a member of its Executive Committee, where he was Chair for two years, as well as the firm’s Compensation Committee.  A lecturer and author of many articles on bankruptcy and insolvency, Mr. Gorney received a Bachelor of Arts Degree from the University of Vermont, a Master of Arts Degree from the University of Pennsylvania and a Juris Doctor degree from Suffolk University Law School in Boston, MA.  He is admitted to the bar in the Commonwealth of Massachusetts; the United States District Court for the District of Massachusetts; the United States Court of Appeals for the First Circuit and the United States Supreme Court.
